These Terms & Conditions (“Terms”) govern your access to and use of the website https://enginestransmissiontan.nl/ (the “Website”), all products and services offered by Engines & Transmission TAN (“we”, “us”, “our”), a company registered in Vlaardingen, The Netherlands (VAT: NL003195866B10). By accessing, browsing, or placing an order on the Website, you agree to be bound by these Terms. If you do not agree, do not use the Website or purchase from us.

1. Use of the Website

  • You must be at least 18 years old or have legal capacity to enter into contracts to use the Website and place orders.
  • You agree to provide accurate, current, and complete information when creating an account or placing an order.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.
  • We reserve the right to suspend or terminate accounts for violations of these Terms.

2. Orders & Contracts

  • All orders are offers to purchase and are subject to acceptance by us. We may refuse or cancel any order (even after confirmation) for reasons including pricing errors, stock unavailability, suspected fraud, or legal restrictions.
  • A binding sales contract is formed only when we send you an order confirmation email.
  • Product images, descriptions, specifications, and prices are for guidance only and may contain errors. We do not guarantee that all information is accurate or complete.
  • Prices are in Euros (€) and include Dutch VAT (21%) unless otherwise stated. Prices exclude shipping costs, customs duties, import taxes, or other fees for international orders.

3. Payment

  • Accepted payment methods are displayed at checkout (e.g., iDEAL, credit/debit cards via Mollie/Stripe, bank transfer).
  • Full payment is required before we process and ship your order (unless otherwise agreed).
  • We use secure third-party payment processors. We do not store your full payment card details.
  • You are responsible for all charges, including any currency conversion fees or bank charges.

4. Shipping & Delivery

  • We ship to the Netherlands, most EU countries, and select international destinations. Shipping costs and estimated delivery times are shown at checkout.
  • Risk of loss or damage passes to you upon delivery (or upon handover to the carrier for international shipments).
  • We are not liable for delays caused by carriers, customs, force majeure, or incorrect delivery addresses provided by you.
  • You must inspect goods upon receipt and report visible damage or shortages to the carrier and us within 48 hours.

5. Returns, Refunds & Warranty

  • Cooling-off period (Right of Withdrawal): For consumers in the EU, you have 14 days from receipt to withdraw from the contract and return unused goods in original condition and packaging. Return shipping costs are your responsibility unless the product is faulty.
  • Refunds (including original shipping costs) will be processed within 14 days of receiving returned goods.
  • Warranty: Most products come with a manufacturer or our warranty (duration stated on product page, typically 6–24 months). Warranty covers material and manufacturing defects only—not misuse, improper installation, racing use (unless specified), or normal wear.
  • Faulty products must be reported within the warranty period with proof of purchase and photos/description of the issue. We may repair, replace, or refund at our discretion.
  • No returns accepted for used/remanufactured parts unless explicitly faulty and within warranty.

6. Intellectual Property

All content on the Website is protected by copyright and other intellectual property laws (see our separate Copyright Notice). You may not reproduce, distribute, or use our content commercially without written permission.

7. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, consequential, special, or punitive damages (including loss of profits, business interruption, data loss, or vehicle damage).
  • Our total liability shall not exceed the amount you paid for the product giving rise to the claim.
  • We are not responsible for compatibility issues, incorrect installation, or misuse of products.

8. Force Majeure

We are not liable for failure or delay in performance due to events beyond our reasonable control (e.g., strikes, natural disasters, supply shortages, pandemics, government restrictions).

9. Governing Law & Disputes

These Terms are governed by the laws of the Netherlands. Any disputes shall be submitted to the exclusive jurisdiction of the competent courts in Rotterdam, The Netherlands. EU consumers may also use the ODR platform for online dispute resolution: https://ec.europa.eu/odr

10. Changes to Terms

We may update these Terms at any time. The version posted on the Website at the time of your order/use is the applicable one. Continued use after changes constitutes acceptance.
